A major court decision in the high-profile case involving former Mesa County, Colorado election clerk Tina Peters

A state appeals court has thrown out her 9-year prison sentence; but not her conviction.

Peters was convicted for her role in allowing access to voting machines following the 2020 election.

But now, judges say the original sentencing judge went too far, by factoring in her political speech and public claims about election fraud.

The case is now heading back to a lower court for resentencing, meaning Peters could face a reduced sentence or potentially something similar.

Peters’ attorney, Peter Ticktin, released the following statement to LindellTV: 

“The Colorado Court of Appeals got it all wrong except for the obvious violation of Tina Peters’ first amendment rights and her sentence, which even Governor Polis could see was unduly harsh.

The trial of Tina Peters was not anything near fair.  Unlike in a murder case which the same court reversed today, because one of the jurors was biased, where one of the jurors was biased in Tina Peters’ case, that was no problem.

About a week ago, even the Taliban let a Colorado resident go free, but Tina Peters remains in prison, tonight.  This is while a state senator who actually committed fraud and forgeries was able to walk away from the courthouse after her sentencing of probation and community service for the same charges.

Unfortunately, the Colorado Court of Appeals just kicked the can down the road rather than to do the honest responsible thing, and give her a new trial, after her kangaroo trial.  She remains in prison after 549 Days.

Now, the Court of Appeals is sending Tina Peters back to the same district court for resentencing.  This is terribly disappointing.  I though that the Court of Appeals had a better understanding of the issues.  Apparently, they did not.

We would be extremely grateful to Governor Polis should he grant clemency to Tina Peters. 

It would be best if the Governor could save us all the drudgery of going through another sentencing hearing by intervening with clemency, to finally put an end to the whole ordeal Tina Peters has suffered and continues to suffer.
